Family Law Specialists

At Lane Buck & Higgins, our experienced family lawyers provide legal advice and representation across all matters of family law including financial separation and divorce, property settlements, parenting arrangements and child support.

We have the knowledge and resources to resolve complex and sensitive family law matters. We are committed to helping you settle your matter as quickly as possible, exploring all avenues from negotiation to mediation, and only proceed with representation in Court if it is absolutely necessary.

Our family lawyers have helped hundreds of family law clients over the years acting on behalf of mums, dads, grandparents, married couples, same-sex couples and de facto couples. We are dedicated to achieving the best possible outcome for you, your children and your financial future.

We can also work with other professionals when resolving your family law matters such as psychologists, family therapists and financial advisers.

We know family law

With locations in Perth, the South West and the Wheatbelt region, our dedicated family lawyers can advise you on family law matters relating to:

In Australia, we have a ‘no fault’ divorce system, which means the Court does not take into account the reason for your marriage ending. Before you can file an application for divorce, you and your spouse must prove you have been separated for at least 12 months.

To be granted a divorce order you must also be able to demonstrate:

  • The marriage has irretrievably broken down
  • Appropriate arrangements have been made in relation to any children of the marriage under the age of 18 years

A divorce order is final after 30 days of it being granted. Although it legally ends your marriage, it does not resolve matters regarding parenting or your property.

Post separation parenting and child support

Protecting the interests of your children is paramount when determining suitable parenting arrangements following a separation. Our experienced family lawyers will guide you through resolving matters such as:

  • Where the children will live
  • How much time the children will spend with each parent
  • How decisions regarding the children will be made
  • Arrangements surrounding financial support of the children

Where possible, we will always aim to settle outside of court.

Property settlement

Deciding who gets what after a separation or divorce can be confronting. At Lane Buck & Higgins, we can assist in formalising agreements around financial matters such as dividing your assets and liabilities, spouse maintenance payments, superannuation splitting and child support.
