Divorce

 

In Australia, we have a ‘no fault’ divorce system, which means the Court does not take into account the reason for your marriage ending. Before you can file an application for divorce, you and your spouse must prove you have been separated for at least 12 months.

 

To be granted a divorce order you must also be able to demonstrate:

  • The marriage has irretrievably broken down
  • Appropriate arrangements have been made in relation to any children of the marriage under the age of 18 years

 

A divorce order is final after 30 days of it being granted. Although it legally ends your marriage, it does not resolve matters regarding parenting or your property. Consulting a divorce lawyer can help you navigate these additional legal matters effectively.
